Appeal Bond set at One Million Five
Hundred Thousand Dollars ($1,500,000.00!)
As you likely know, Life Principles Trust and Forest Grauel both filed
a Five million dollar ($5,000,000.00) lawsuit against Sandy Spring Bank
for Breech of Fiduciary Trust, breech of contract, malpractice and
other good causes. In an obvious retaliation against them, Sandy
Spring Bank filed what is called an "Unlawful Detainer Action" against
Forest and Aileen Grauel in District Court, Landlord Tenant Division
seeking to have the Grauels thrown off the property under the pretext
of "needing to prepare the property for sale, likely to a developer."
This Past Monday Judge Patricia Mitchel disregarded arguments made on
behalf of Forest & Aileen Grauel by Attorney Alexander Crow of
Noble & Crow, a Rockville Law Firm. Mr. Crow was arguing that
there was no reason for the eviction until the major law suit in the
higher Circuit Court was resolved. Mr. Crow cited both statutory
and
case law which he felt clearly precluded an eviction until the issues
of Title were resolved in the Circuit Court which is also the higher
court over District Court (Landlord Tenant Court is considered by many
to be the dregs of District Court, often referred to as a "meat
grinder."
Not only did Judge Patricia Mitchel rule against the Grauels to have
them evicted, but likely knowing that the the Grauels would appeal the
ruling, and possibly have her ruling overturned, Judge Patricia Mitchel
set the appeal bond on the eviction ruling at an absurdly ridiculous
$1,550,000.00!
The result is that Forest and Aileen are under an Eviction Order and
will be removed by force from their home of 33 years. It is clear
to
the Grauels and those who support them, that Sandy Spring Bank is
seeking to destroy their ability to continue fighting for Rachel's
Field. Moreover Sandy Spring's attorney, Richard Lyon, is likely
still
furious that our valiant attorney Christopher Millard, abruptly called
to Military duty as a JAG lawyer, had filed much deserved malpractice
charges against him.
Aileen and I have thrown literally everything we have into this
struggle, and what has come to be called, "the Battle for Rachel's
Field. I am asking that the recipients of this letter write open
letters to the editor
and copy them to Judge Mitchel at the address found below. I am
asking
for a fire storm of support, and feel it is necessary if we are to have
any chance of prevailing against what has been called the "Wall of
Evil" which seeks to destroy this magnificent project in support of the
Culture of Life. Here is Judge Mitchel's address at the courthouse;

I implore you to come to our aid. Your letter written ASAP will
be of
great support as our Attorney will likely be requesting a
reconsideration hearing. We are unaware if Judge Mitchel is
pro-abort
or if she has been pressured by the bank. We only know that her
ruling
was cruelly unfair and she needs to know that the word is out of how
she treated two senior citizens who are fighting against a heartless
bank who can only see houses being built in place of Rachel's Field.
